Terms of Service

This Terms of Service Agreement (hereinafter referred to as the "Agreement") is a legally binding agreement between you, the user of the Thravos platform (hereinafter referred to as "User" or "you"), and Thravos Inc (hereinafter referred to as "Thravos," "the Company," "We," or "Us").

The purpose of this Agreement is to set forth the terms and conditions under which you may access and use the Thravos platform and participate in the activities and programs offered through the platform, including the earning of rewards and the conversion of such rewards into TRVSs. By accessing or using the Thravos platform, you acknowledge and agree to be bound by all of the terms and conditions set forth in this Agreement. If you do not agree to be bound by this Agreement, you should not access or use the Thravos platform.

1. Responsibility for Use

1.1 By using the Thravos platform, you agree to abide by all laws and regulations, including but not limited to tax laws, intellectual property laws, and data protection laws.

1.2 You also agree to use the platform in a manner that does not harm the platform or its users.

1.3 Thravos reserves the right to remove or limit access to any member who violates these terms of service.

2. Changes to the Terms of Service

2.1 Thravos reserves the right to modify these terms of service at any time, with or without prior notice.

2.2 Any changes will become effective immediately upon posting the revised terms on the Thravos platform.

2.3 Continued use of the platform following modifications indicates acceptance of the modified terms.

2.4 Users are encouraged to regularly review the terms of service to remain informed of any changes.

3. Changes to the Platform

3.1 Thravos may make changes to the platform, including but not limited to the addition or removal of features, at any time, with or without prior notice.

3.2 Thravos will use commercially reasonable efforts to provide notice of any material changes but is not obligated to do so.

4. Accessing the Platform

4.1 Thravos grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the platform in accordance with these terms of service.

4.2 This licence is subject to continued compliance with these terms of service.

4.3 Thravos reserves the right to revoke this licence at any time for any reason, including but not limited to, violation of these terms of service.

5. Prohibited Use

5.1 The Thravos platform may only be used for lawful purposes and in accordance with these terms of service.

5.2 You agree not to use the platform in any manner that:

• (a) Infringes the intellectual property rights of others, including but not limited to patents, trademarks, copyrights, or trade secrets.
• (b) Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise offensive.
• (c) Involves the transmission of junk mail, spam, chain letters, or any other form of unsolicited commercial communication.
• (d) Interferes with the operation of the platform, including but not limited to the introduction of viruses, Trojans, worms, or other harmful code.
• (e) Accesses or collects information about others without their consent, including but not limited to personal information or data.
• (f) Engages in commercial activity without the prior written consent of Thravos, including but not limited to the promotion of products or services.

5.3 Prohibited Content Monetization

Users are expressly prohibited from monetizing or otherwise deriving financial benefit from the following categories of content on the platform:

• (a) Adult Content and Services: Any content containing nudity or explicit sexual acts, including without limitation subscriber-only nude images, adult audio, or video/live chat.
• (b) Intellectual Property Infringement: Content that infringes or misappropriates the intellectual property or proprietary rights of any third party, including but not limited to trademarks, trade secrets, or patents.
• (c) Copyright-Infringing Content: Unauthorized distribution, reproduction, or monetization of copyrighted material, including leaked music, films, or other protected works.
• (d) Violent Extremism and Hate Speech: Content that engages in, encourages, promotes, or celebrates unlawful violence or expresses hate toward any group or individual based on race, religion, disability, gender, sexual orientation, national origin, or any other immutable characteristic.

Violation of this section may, at the sole discretion of Thravos, result in removal of the content, suspension, or termination of the account, and may be referred to law enforcement where applicable.

6. Disclaimer of Warranties

6.1 The Thravos platform and all content, materials, information, software, products, and services provided on or through the platform are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied.

6.2 Thravos disclaims all implied warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

6.3 Thravos makes no representations or warranties of any kind with respect to the accuracy, completeness, or reliability of any content, materials, information, software, products, or services provided through the platform.

7. Limitation of Liability

7.1 Thravos shall not be liable for direct, indirect, incidental, special, or consequential damages arising out of or in connection with the platform or its content, materials, information, software, products, or services, including but not limited to loss of data or profits.

7.2 This limitation applies regardless of the form of action, whether in contract, tort, or otherwise, and applies even if Thravos has been advised of the possibility of such damages.

7.3 In no event shall the total liability of Thravos to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the platform.

8. Indemnification

8.1 You agree to indemnify, defend, and hold harmless Thravos, its affiliates, and their respective officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to:

• (a) Your use of the platform or the content, materials, information, software, products, or services provided on or through the platform.
• (b) Your violation of these terms of service.
• (c) Your infringement of the intellectual property rights of others.

9. Dispute Resolution

9.1 Any dispute arising out of or relating to these terms of service or your use of the platform shall be resolved through arbitration.

9.2 Arbitration shall be conducted under the International Chamber of Commerce rules, except as otherwise provided in these terms of service.

10. Governing Law

10.1 These terms of service shall be governed by and construed in accordance with the laws of the jurisdiction in which Thravos is incorporated, without giving effect to any conflict of law principles.

11. Entire Agreement

11.1 These terms of service, together with the Thravos whitepaper, constitute the entire agreement between you and Thravos with respect to the use of the platform.

11.2 This Agreement supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the platform.
